Which year should we review?
Federal refund claims are open for 2023, 2024 and 2025, and for 2022 if you filed it on extension less than three years ago. Virginia claims are open for the same years, and for 2022 until November 1, 2026 if you filed it on extension. Filed late, or asking about 2021 and earlier? See which years can still pay you back.

- every W-2 and 1099
- mortgage interest, property tax, childcare and tuition statements
- charitable receipts, medical expenses, business income and expenses
- the return for the year before, if you have it: it shows carryforwards

If nothing was missed, the report says that.
Which years can still pay you back
Federal law gives you three years from the filing deadline to claim a refund on a return filed by that deadline, and a return filed on extension keeps three years from the day it was filed. Virginia counts three years from its own deadlines, May 1, or November 1 for a return filed on extension. The drawing shows the federal windows; a row names Virginia’s date where it is still open after the federal one.

A federal return filed late keeps three years from the day it was filed, but a claim gets back only tax paid in the three years before it, and withholding counts as paid on April 15 after the tax year. Tax paid in the last two years may also be claimable. A Virginia return filed late keeps only the three years from its May 1 deadline. So for a year drawn closed, the review works out what, if anything, can still come back.
A review is a report and a recommendation; it is not a filed return. No refund is promised, and whether a year stays open is governed by IRC §6511 and, for the Virginia return, Va. Code §58.1-499.
